What the scan checks for (15 clauses)

  1. No-pets ban — RTA s.14, pets are allowed
  2. Pet deposit — RTA s.105–106, deposits beyond last month’s rent are prohibited
  3. Extra security/damage deposit — RTA s.105, only last month’s rent may be collected
  4. Key deposit over $200 — RTA s.106, key deposits must reflect actual replacement cost
  5. No-guests / no-overnight-guests clauses — RTA s.3, unreasonable rules are void
  6. Forced 12-month lease renewal — RTA s.38, tenancy becomes month-to-month after the term
  7. Illegal late fees — penalty clauses are void under the RTA
  8. Entry without 24 hours’ notice — RTA s.27 requires written notice
  9. Tenant pays for appliance/furnace repair — RTA s.20, that’s the landlord’s responsibility
  10. Smoking fines beyond actual damages — penalty fines are void
  11. Mandatory landlord-chosen internet/cable — Consumer Protection Act + RTA s.3
  12. Tenant pays property taxes — that’s a landlord cost
  13. Waiver of RTA rights — RTA s.3, tenants cannot waive their rights
  14. Rent increases above the 2.1% guideline — RTA s.120, without LTB approval
  15. Illegal eviction clauses — RTA s.37, only the Landlord and Tenant Board can order eviction
